At Spelly we care about the privacy of your data and are committed to protecting it. This Privacy Notice (hereinafter referred to as the “Notice”) is here to help you to understand how your personal data is processed when you’re using our website, located at https://spelly.io (“Website”) or purchase and download the Spelly plugin (“Plugin”). Since this Notice applies to both Website and Plugin we will refer to them as “Service”.

1. Who is responsible for processing your data?

2. How do we collect and use data?

When you access our Service we will automatically receive certain technical data, you can provide some data yourself.

2.1. Automatically collected data

We automatically collect certain data to operate, maintain and improve our Service. Such data includes:

  • Browser and device information: we receive information about the device which you are using (type, model, online identifiers such as IP address, MAC address, etc.) also we receive information about your browser (type, version, language, etc.)
  • Usage information: we collect the information relating to the usage of the Service, including your actions on the Service if such actions are present;
  • Cookies and similar technologies. We use cookies for analytical purposes and to provide you with the features of our Service. You may disable cookies in your browser settings at any time. 2.2. Data you give us

In order to provide you with some features of our Service, we may ask you for some data. Such data includes:

  • Registration data: email address
  • Team member data: name of the team, team icon, email addresses of team members, additional optional data such as team member names, jobs etc.
  • Payment data: payment method,  payment details (card number). Please note that we do not store this data, the main processing activities with payment activities are performed by FastSpring.

3. Why do we use your data?

3.1. Provide you with access to our Services. We process your personal data to provide you with access to our Service so that you can view its pages and see its contents, register accounts and create teams. We may also use your data to get in touch with you. The legal basis for processing is the performance of a contract.

3.2. To improve your interaction with our Service. We may use some of your personal data to improve your interaction with our Service, including: for analysis and statistics, as well as for the development of new services. The legal basis for processing is a legitimate interest. This kind of processing consists mainly of depersonalized data, hence it does not override your rights and freedoms.

3.3. Marketing. If you give us your consent, we will use your data for direct marketing. You can always opt-out from receiving emails from us by clicking the link in the email, as an alternative you may withdraw your consent by sending us an email to privacy@spelly.io with email topic “newsletter cancelation”.

3.4. Compliance with legal requirements. We may process certain personal data in order to comply with legal requirements.

5. How do we share and disclose data?

We may share your personal data under the following conditions:

5.1.  Safety, Legal purposes, and Law enforcement. We will disclose your personal data to third parties to the extent necessary to:

  • comply with a government request, a court order or applicable law;
  • defend ourselves against third-party claims;
  • assist in fraud prevention or investigation

5.2. Business transfers. We will not sell your personal data to any company or organization. However, we may transfer your personal data to a successor entity In such an event, we will notify you before your personal data is transferred and becomes subject to a different privacy notice, you will be able to opt-out of transferring your data to the new owner.

5.3. With your consent. In cases where you have provided your consent, we may share your personal data, as described at the time of consent.

5.4. Third-party service providers and contractors. We use the services of third parties and contractors to process personal data on our behalf. For example, e-mailing, research and analysis, payment providers (FastSpring) etc. When using the services of third parties, we conclude agreements that require them to take appropriate technical and organizational measures to protect your personal data.

6. How do we handle your data?

6.1. Security. We provide appropriate technical and organizational measures to protect personal data we process and maintain. For example, as for organizational safeguards, data that we receive is available only to authorized personnel, as for technical safeguards we use AES-256 encryption.

If you have a reason to believe that your interaction with our Service is no longer secure, please immediately notify us by contacting us in writing at privacy@spelly.io.

6.2. Retention of your personal data. We retain your personal data for as long as necessary to fulfill the purpose of the data processing in accordance with this Notice. We typically store your data for a period of 18 months from the time we receive your data. If you do not use our Service or interact with us for 18 months, we will remove your personal data from our systems, as we do not store not relevant data. However, we may retain some data for backup and for compliance with our legal obligations.

7. How can you manage your personal data?

If you would like to access, review, update, rectify, and delete any personal data that we hold about you may use your account settings. When you want to exercise any other of your rights such as a right to object or restrict processing and a right to data portability, you can email us at privacy@spelly.io. In case you are unhappy with how we handle your data, you have a right to lodge a complaint with a supervisory authority, in Ukraine, the role of supervisory authority is performed by the Parliament Commissioner for Human Rights.

8. Do we transfer your data to other countries?

Generally, we do not intend to transfer your personal data outside of the European Economic Area. However, in the event when we need to transfer your data, we will use appropriate safeguards.

9. How do we update this Notice?

Applicable law and our practices change over time. If we decide to update our Privacy Notice, we will post the changes in our Services. If we materially change the way in which we process your personal data, we will provide you with prior notice, or where legally required, request your consent prior to implementing such changes. We strongly encourage you to read our Privacy Notice and keep yourself informed of our practices.
